Information clause

On the basis of art. 13 section 1 and 2 of Regulation no. 2016/679 of 27.04.2016 of the European Parliament and of the Council regarding the protection of natural persons with regard to the processing of personal data and free transfer of such data, as well as the repeal of Directive 95/46/WE (general data protection ordinance) (Official Journal of the European Union | L 119/1) (hereinafter: RODO), we inform that:

  1. Objectives and legal basis for the processing of personal data

Personal Data Administrator processes your personal data for the following objectives:

  1. preparation and presentation of an offer (including registration for events organized regularly by the Personal Data Administrator), as well as execution of the contract on the basis of art. 6, section 1, letter b RODO;

  2. fulfillment of legal obligations borne by the Personal Data Administrator in relation to the execution of a contract with the Contractor on the basis of art. 6, section 1, letter c RODO, particularly on the basis of tax and accounting regulations;

  3. enforcement of claims, conduction of legal and recovery actions on the basis of art. 6, section 1, letter f RODO;

  4. publication of the Contractor’s image on the Personal Data Administrator’s website for advertising and marketing purposes on the basis of art. 6, section 1, letter a RODO, which means the person who the data regards, consented to the processing of his/her personal data;

  5. publication of the Contractor’s personal data on the Administrator’s website in regard to Contractor’s appearance in events organized by the Personal Data Administrator for marketing purposes on the basis of art. 6, section 1, letter a RODO, which means the person who the data regards, consented to the processing of his/her personal data.

 

  1. Voluntary personal data disclosure

Personal data disclosure is necessary for the proper execution of the contract. Refusal to disclose your personal data will result in inability to conclude the contract, as well as to take part in the events organized by your Personal Data Administrator (Exchange). Image disclosure, as well as other personal data disclosure in order for it to be published on the Personal Data Administrator’s website is voluntary and does not affect the ability to conclude the contract or take part in the events organized by the Personal Data Administrator.

  1. Data processing time

Your personal data will be processed for the period necessary to execute processing objectives stated in point 2, which encompasses:

  1. enforcement of possible claims regarding the concluded contract, according to which and with regard to which your personal data was processed, until the end of the limitation period, according to the Civil Code,

  2. the scope of fulfilling legal obligations borne by the Personal Data Administrator with regard to the execution of the contract (for instance tax laws, accounting and civil law regulations) – for the periods indicated in these regulations or the period until the fulfillment of those regulations by the Personal Data Administrator,

  3. the scope of internal administrative purposes, as well as constant and uninterrupted business operation by the Personal Data Administrator, until the fulfillment of legally justified business of the Personal Data Administrator which is the basis for this processing or until your objection against such processing;

  4. the scope of processing of the Contractor’s image and other personal data published on the website of the Personal Data Administrator until the time when the person who the data regards asks the Personal Data Administrator to delete the data or withdraws the consent.

 

  1. Personal data recipients

Your data might be transferred to the following personal data recipients or recipient categories:

  1. government bodies, for instance ZUS (Social Insurance Institution), tax office, public prosecutor’s office, police, President of the Personal Data Protection Office, President of the Office for Competition and Consumer Protection upon their request,

  2. entities authorized by the Personal Data Administration, including our co-workers, post office, courier companies, lawyer’s offices, accounting firms, IT providers and technicians, as well as service providers for current operations of the Personal Data Administrator.

Based on agreements and circumstances, the abovementioned entities act on our order or independently select objectives and the way data is processed. The list of providers is accessible in the Personal Data Administrator’s office. Our providers have their registered offices mainly in Poland and other countries of the European Economic Area (EEA), as well as outside EEA. Your personal data transferred outside of EEA will be legally secured, so that our providers guarantee high level of personal data protection. Those guarantees result particularly from the obligation to implement standard contract clauses adopted by the European Commission or participation in the Privacy Shield programme, established on the basis of the European Commission’s decision 2016/1250 from 12th July 2016, regarding the adequacy of security provided by the EU-USA Privacy Shield.

  1. Rights of the person the data regards

On the basis of RODO you have the right to:

  • demand access to your personal data

  • demand correction of your personal data

  • demand withdrawal of your personal data

  • demand limitation of the processing of your personal data

  • issue an objection to the processing of personal data

  • demand transfer of personal data

  • in case of granting consent for the processing of image or other personal data published on the Personal Data Administrator’s website you are allowed the right to withdraw the consent for the processing of personal data within that scope at any moment, and the withdrawal does not influence the legality of data processing on the basis of your acceptance before it was withdrawn

In order to exercise the abovementioned rights you should contact the Personal Data Administrator in writing, at the address: Antoniego Abrahama 18, 81-825, or via email: ohler@ohler.pl
In case of submission to the Personal Data Administrator any of the abovementioned demands, the personal data administrator will provide information concerning actions taken with regard to the demand submitted without delay, a month from reception of the demand at the latest.
In case of withdrawing the consent for the use of image or other personal data published on the Personal Data Administrator’s website, the data will be deleted immediately.
If need be, the Personal Data Administrator can extend the one-month deadline for further two months on the basis of the complicated nature of the demand or the number of demands.
In every case the Personal Data Administrator will inform you about the extension and will name the reasons for extension within a one-month period from the submission of the demand.

  1. Complaint to the supervisory body
    If you believe that personal data processing is in violation of RODO, you have the right to file a complaint to a supervisory body, particularly in the country of residence, workplace or the place of the alleged violation.

 

The supervisory body as defined by RODO in Poland is the President of the Personal Data Protection Office.

 

  1. Transfer of personal data to a third country or international organization

Please be informed that personal data will not be transferred to third countries / international organisations.
